			<content:encoded><![CDATA[<p>MEDICAL LOSS RATIO REBATES Under PPACAs medical loss ratio MLR rules, health insurers must issue rebates if the insurer failed to meet the MLR percentages identified in PPACA. This means, unless at least 85% of each premium dollar or 80% in the small group and individual markets is spent on medical care, the carrier must issue rebates. The final guidelines, which were recently issued, require insurers to issue the rebate checks to the policyholder generally the employer. The insurance carriers have subsequently made the employer responsible for distributing the funds appropriately. Modifications in the final guidelines include:Employees in group health plans can receive rebates in a manner that is not taxable.A proposal that consumers receive a notice showing not only the amount of any rebate, but also the insurers MLR even if there is no rebate. It is anticipated that these will be published in the spring of 2012In 2011, limited medical plans received a special circumstances adjustment to their MLR in the form of a multiplier of 2.0 for 2011. The final rule phases it down from 1.75 in 2012 to 1.5 in 2013 and to 1.25 in 2014. Mini-med plans will not be allowed after 2014 due to the prohibition on annual limits for essential benefits.The final</p>

			<content:encoded><![CDATA[<p><strong>New Baby Financial Checklist</strong></p>
<div>Baby&#8217;s coming, so it&#8217;s time to get your finances in order.  Here are a few things that will save you time and money for your family&#8217;s future:</div>
<ol>
<li><strong>Health Insurance for baby</strong> - If Dad or Mom have health insurance when baby is born, rest assured your baby will be automatically covered for the first 31 days of life under either parent&#8217;s plan.  However, it is important to contact your insurance company ASAP to find out what they require&#8230;sometimes it&#8217;s automatic, but other times you must send in a new enrollment form (such was the case with my family insurance).</li>
<li><strong>Lower health insurance costs -</strong> ask your agent or broker to check into individual health insurance costs for dad and baby, especially if it&#8217;s your first child.  This can often lead to lower premiums than a group plan.</li>
<li><strong>Savings</strong> - During an airplane emergency, we are taught to take the oxygen for adults first, and then assist our children.  The same applies to your savings&#8230;make sure you do what you need to do for yourself first &#8211; reduce expenses, pay off debt, fund your IRA.  This will establish a solid foundation so you are better equipped to help your child.</li>
<li><strong>Life insurance</strong> &#8211; no one likes this subject, but who is going to pay for your child&#8217;s care if mom or dad die prematurely?  Plan on adding 20 more years of insurance now.   It&#8217;s the best gift you can give your family.</li>
<li><strong>Disability insurance</strong> &#8211; equally scary is the possibility mom or dad lose their ability to earn a living, because of an unexpected accident or illness that keeps them out of work for a period of time.  Ask your agent to review your income replacement plan for anyone working to put food on the family table.</li>
</ol>

DRUG COVERAGE (PART D)</p>
<p style="text-align:left;">Medicare offers prescription drug coverage to everyone with Medicare. Prescription drugs can be a major cost as you age and they are NOT covered by Original Medicare. There are two ways to get Medicare prescription drug coverage:</p>
<p style="text-align:left;">1.  Medicare Prescription Drug Plans (sometimes called &#8220;PDPs&#8221;). They can be added to Original Medicare and Medicare Supplement (Medigap) Plans.</p>
<p style="text-align:left;">2.  Part D coverage may also be included in a Medicare Advantage  plan (sometimes called MA-PDs).</p>
<p style="text-align:left;">When purchasing a stand-alone Part D insurance plan to go along with a Medicare Supplement (Medigap) plan, it provides protection against catastrophic health care costs.</p>
<p style="text-align:left;">Part D plans are offered through private insurance companies. Plans vary widely, as do prices. How specific drugs are covered also differs among plans, too. Even if you do not take a lot of prescriptions now, you should still consider joining a Medicare drug plan. To get Medicare prescription drug coverage, you must join a plan run by an insurance company or other private company approved by Medicare. Each plan can vary in cost and drugs covered.</p>
<p style="text-align:left;">If you decide NOT to join a Medicare drug plan when you are first eligible, and you <span style="text-decoration:underline;">do not</span> have other <span style="text-decoration:underline;">creditable prescription drug coverage</span>, you will likely pay a late enrollment penalty. See BELOW: Employer Coverage.</p>
<p style="text-align:left;">There are two ways to get Medicare prescription drug coverage:</p>
<p style="text-align:left;">1. Medicare Prescription Drug Plans. These plans (sometimes called “PDPs”) add drug coverage to Original Medicare and an option to add a Medicare Supplement (Medicare Gap) plan.</p>
<p style="text-align:left;">2. Medicare Advantage Plans (like an HMO or PPO) or other Medicare health plans that offer Medicare prescription drug coverage. You get all of your Part A and Part B coverage, and rescription drug coverage (Part D), through these plans. Medicare Advantage Plans with prescription drug coverage are sometimes called “MA-PDs.”</p>
<p style="text-align:left;">Who Can Get Medicare Drug Coverage?</p>
<p style="text-align:left;">To join a Medicare Prescription Drug Plan, you must have Medicare</p>
<p style="text-align:left;">Part A <strong><span style="text-decoration:underline;">OR </span></strong>Part B. To join a Medicare Advantage Plan, you must have Part A <span style="text-decoration:underline;">and</span> Part B. You must also live in the service area of the Medicare drug plan you want to join.</p>
<p style="text-align:left;">OPTIONAL:  Employer or Union Health Coverage—Health coverage from your, your spouse’s, or other family member’s current or former employer or union. If you have prescription drug coverage based on your current or previous employment, your employer or union will notify you each year to let you know if your prescription drug coverage is CREDITABLE.<br />
(This means that your employer prescription coverage is equal to or better than the national medicare Part D coverage.) Keep the information you get each year as you will have to produce a copy of this letter if you decide to change from your employer coverage. Call your benefits administrator for more information before making any changes to your coverage.</p>
<p style="text-align:left;"><span style="text-decoration:underline;">Note</span>: If you join a Medicare drug plan you, your spouse, or your dependants may lose your employer or union health coverage. You also may not be able to drop your employer or union drug coverage without also dropping your employer or union health (doctor and hospital) coverage. If you drop your employer or union coverage, you may not be able to get it back.</p>

			<content:encoded><![CDATA[<p> Employer group health plans that include prescription coverage to Medicare eligible individuals must distribute a Notice of Creditable Coverage (or Noncreditable Coverage) each year on or before the Annual Election Period for Medicare.  This year that date is October 15th.  In the past it has been November 15th, so employers may not be aware of this change.  These notices are important because if an individual does not maintain creditable coverage for a period of 63 days or longer following his or her initial enrollment period for Medicare Part D, then the individual will be subject to a late enrollment penalty.</p>

<p>Shortly, insurance carrier will be sending employers notice on whether or not the prescription plan offered is considered creditable or not.  Based on this information, employers will be required to provide the appropriate notice to employees by October 15th.</p>

Appeals filed last week by the U.S. Department of Justice, a number of states and a business group make it all but certain that the U.S. Supreme Court will decide constitutional questions related to the Affordable Care Act (ACA) next year before the presidential elections. Last week the Justice Department filed a petition formally asking the Supreme Court to promptly consider the constitutionality of the ACA by reviewing the 11th Circuit Court of Appeals’ prior ruling.  The Department is appealing a decision by a three-judge panel of the U.S. Court of Appeals in Atlanta holding that the ACA’s requirement that all Americans purchase health insurance is unconstitutional.  Lawyers for 26 states challenging the ACA also pressed the court to hear the case speedily, as did the National Federation of Independent Businesses (NFIB). While the Justice Department wants the high court to uphold the constitutionality of the health care law, the states and NFIB want the court to strike down the entire law, not just the individual mandate. Federal court decisions on the constitutionality of the law so far have been split.<br />
